The work on bug https://bugs.launchpad.net/ubuntu/+source/linux/+bug/430809 seems to fix my problem with rfkill but the patch is applied over the kernel 2.6.31-12 so my interface is enabled but the wireless extensions are not availabe as I have explained above.
