[panel] No appname and menu bar when restoring Empathy

Dell Latitude D600 laptop
I wonder if someone else can reproduce this issue:
1. Start Empathy - it's menu does appear in the panel.
2. Click the Close button in Empathy's title bar which actually minimizes Empathy to the app indicator menu in the panel.
3. Open up the app indicator menu and click on "Chat" to restore Empathy.
4. When you hover the mouse over the panel - Empathy's menu no longer appears in the panel even though Empathy does have the focus or at least it looks like it does.
I have to click on the desktop to remove focus from Empathy's window and than click on Empathy's window to make Empathy's menu appear again. I hope I have explained this well enough. The reason I think it might be related to unity-2d is that I run 11.04 final on my desktop using unity and compiz and Empathy does not exhibit this behavior.

I forgot to mention the version of Empathy is 2.34.0.
