Not sure if this counts as a duplicate of bug 693777, but check the screenshot for what I mean. If nothing's focused, as happens under a few circumstances (for instance, right now, I can get to a no focus condition by dragging windows around, with wobbly enabled, so that the launcher hides; or, indeed, minimising a fullscreen window), then I can click on the menu area on the unity panel, and click "close" on the File menu that appears. At which point unity disappears (as you'd expect...).

Hi Toby. I actually filed this one a few hours ahead of you (bug #728790), so yours is a duplicate ;)
Bug #717496 relates to this in an interesting way, too. One thing that makes this particularly easy is that the top panel appears to be the title bar for whatever window you have maximized. Here is another case where the top panel isn't what it looks like, leading to disaster.
