Top panel has a confusing relationship with the front-most maximized window

First, I will reproduce the problem…
* Maximize a window in any application (GIMP is a particularly nice example, since it's awesome to maximize it in Unity).
* Bring another unmaximized window into focus.
* Try to close the maximized window, to move it, or to bring it into focus without touching its contents.
The current art assets for the top panel highlight this problem: the top panel looks like it is the title bar for that maximized window, but that is actually only the case when the maximized window is in focus! The only thing serving to communicate this is the window title. That's confusing and frustrating. For GIMP especially (and really any multi-window application), this will interrupt a user's flow on a frequent enough basis to be a problem.
One solution is for the top panel to maintain the window controls (and draggable titlebar-esque area) of the front-most maximized window, regardless of which window is in focus. So, have the global menu and the title bar proxy change as separate entities.
