so the TestFolder in the trash is NOT empty.

this one's empty.

now what happens here is not clear. does it replace the new one with the old one, the old one with the new one, or does it offer you options?
OP and you (I think?) say that it just sort of makes the original non-empty TestFolder disappear:

but Julien and I instead get a dialog that is aware of this conundrum and asks the user to act.
