Yes I am in this discussion...
TO ALL WHO MAY CONCERN : THE FIX IS BELOW:
1) Download the patch or copy and paste it from http://www.spinics.net/lists/linux-wireless/msg58213.html (as said earlier by Vince)
2) save it as a .patch file (fix.patch is the upload)
3) aply the patch
4) build the driver (try this link if you don't know how http://wireless.kernel.org/en/users/Download#Building_and_installing )
5) reboot
If people are insterested I have a semi-custom kernel package built with the patched driver, it's a 64bit preempt , but I can post it somewhere.
