I am affected by this as well. I tried http://kernel.ubuntu.com/~kernel-ppa/mainline/v3.9-rc8-raring/, and it still happened there.

My machine is a Dell XPS 12; a bit different but still has a Cypress touchpad. For now I am working around this by blacklisting the 'psmouse' module. I tend to use a wireless mouse over trackpad anyway, so this is annoying but not insurmountable.
