Comment 7 for bug 612348

When I saw this, it was in a two-way fight; me and one AI. An AI soldier was stuck in the building doorway, and one of mine on the flag outside the entrance.

Something that may be helpful is that apparently my stuck soldier had no home. I destroyed every military building that supposedly had soldiers in the fight, and he did not leave, although all my other soldiers hanging about waiting for the fight to finish did.
