I am also unable to recreate the original bug with either update-notifier and update-notifier-common 0.70.9 in hardy-updates or update-notifier 0.70.7, the original released version. I tested with the Xubuntu alternate from 20081021 (the earliest I had on hand) to see if the isos had changed in a way that addressed the issue, but still got the option to "Run upgrade".
I do note that I was able to successfully update with the -proposed version of update-notifier as well as perform an upgrade.
