After clicking and reading the new 'legal notice' in the Unity dash each subsequent automated back-up would end with the following error message;
Could not back up the following files. Please make sure you are able to open them.
/home/[USERNAME]/.cache/unitydashlegalseen
Manually finding the file and changing the file permission to 'read and write' seems to have fixed the problem but I am assuming that having to do that is not the expected behaviour.
