I can reproduce the behaviour in Martin's test case (https://bugs.edge.launchpad.net/ubuntu/intrepid/+source/linux/+bug/283316/comments/11) on one of the optical drives in my desktop, but not on the other.
I cannot reproduce any misbehavior using eject(1), only manually opening the drive when the tray is open.
