It did NOT work for me if I marked the ntfs partition and the fat32 (restore) partition as "don't use". I tried this several times and the only way I got 'round this was to run "ubiquity --no-migration-assistant".
I've tried this on two separate laptops (Thinkpad Z61t and Dell D531, both came with XP preinstalled) - they both have one ntfs and one fat32 partition.
