I consulted with one of Red Hat's open source lawyers on Friday when this was just starting to get rolling and he confirmed this. Nagios Enterprises, LLC is allowed to use the Nagios trademark in the naming of their projects/products because they own the trademark. Additionally, while problematic from a community perspective (I'm saying that, not him) assuming the licensing is handled properly then there is not legal issue in rebasing, either.

The package name is a little more subjective in my opinion. I'm okay with it having nagios in the name because it's produced by Nagios Enterprises as was mentioned earlier.
