I think you won't have a problem if it's based on the LLC repo, as Andy Brist (<email address hidden>) is asking for it. But I think you should ask your legal dept before use "nagios" and a "forked" version for it (from a LLC point of view).

Maybe packages names are outside trademark things, but don't play trademark names without a legal dept that support you.
