We think that this seems to be an interplay between the kernel bug, ohai, and Ruby 1.9.3. I was unable to reproduce the crash using the opscode omnibus installer (http://www.opscode.com/blog/2012/06/29/omnibus-chef-packaging/) which uses a bundled ruby 1.9.2, so you could potentially try that as an alternative to patching OHAI.
