Bug still exists, tested with quantal:
stock kernel (3.5.0-17)
mainlinee build (3.7.0-030700rc2-generic)
Both kernels show the same behaviour.
As in previous releases, can be worked around by disabling the brightness_switch_enabled parameter:

# echo N > /sys/module/video/parameters/brightness_switch_enabled
