Since this ticket got changed from systemd to linux it seems to be a kernel bug. I wonder what the change from upstart to systemd caused to reveal this issue. Anyways, in this case it could make more sense to forward this to upstream so I have done this: https://bugzilla.kernel.org/show_bug.cgi?id=156761
