Do you happen to know if there was a prior Ubuntu release that did not exhibit this bug?

Also, the v3.8-rc2 mainline kernel is now available. Can you test that kernel as well? It can be downloaded from:
http://kernel.ubuntu.com/~kernel-ppa/mainline/v3.8-rc2-raring/
