I have had some unexpected troubles to setup the test environment but know I have a partition with the new alpha ubuntu distrib (hardy heron) with 2.6.24 kernel (uname -a :
Linux pc-fixe2 2.6.24-1-generic #1 SMP Fri Dec 7 22:06:43 GMT 2007 x86_64 GNU/Linux)

I have patched the r8169.c and recompiled modules, regenerated initrd (and verified the the modified module was actually used by the kernel through a syslog message and tested WOL : magic packet WOL is still not working (and again I have checked that the next boot on the XP partition enables the WOL through magic packet).

I have only applied the second patch (not the first one).
