I've had this issue since edgy, and I just used the 'sudo iwpriv eth1 set_mode 7' thing every time I moved away from my AP. Unfortunately this doesn't work any more in Hardy. I still get limited at around 100KB/s sometimes, but when i run the command i get 'Invalid command : set_mode'.
I'm using the iwl3945 drivers now, so I'm not sure if this bug is limited to ipw3945. My laptop is a HP pavilion dv5285ea.
I'll try upgrading the firmware on my openwrt router to see if that fixes anything.
