Have issues with my 5300 card, and i made some testing.
wireless n is unstable if you add ap_scan=1 or scan_ssid=1 in wpa_supplicant.conf
if i set them to 0 and add my network into wpa_supplicant.conf it connects at 300mbit/s if i do som bwtesting i get good n performance! as soon as i enable one of these settings, the tx bitrates starts jumping up and down...
if i enable debugging i wpa_supplicant i can see that it goes down to 1mbit everytime a "CTRL-EVENT-SCAN-RESULTS" is made.

tx bitrate: 300 Mbit/s - when scanning is disabled.
dont't know if it help you to figure out the problem
i still get some Tx excessive retries: and Invalid misc: but the performance is better!
