Sorry I'm not more clear.

In Lucid, GTK apps may have a grab target for the window in the area to the right of the menu bar. That is, if you click and drag in this region, you will drag the entire window. This behavior seems to be theme-dependent: It exists in Ambiance, Radiance, and Dust, but not in Clearlooks or New Wave. This is perfectly fine.

In order to emphasize that the menu bar acts in the same way as the title bar (vis-a-vis dragging), those first three themes all make the menu bar the same color as the title bar. In Clearlooks, the menu bar is a very different color than the (focused) title bar, indicating that it is not a grab target.

New Wave adopts the appearance of Ambiance, Radiance, and Dust, in that the menu bar and title bar are the same color. It seems to me that it should also adopt the same behavior, for consistency across themes. (As such, you may legitimately argue that the bug is only in gnome-themes-ubuntu; New Wave itself shouldn't have to conform to pattern of other themes.)
