can't change sound when using menus

Expected:
I would expect to be able to change the sound level even if my mouse is currently over a menu. I can normally adjust the sound through the volume knob at the front of my laptop.
What happened:
No sound level changes when mouse has activated a menu and I try turning the sound adjust knob on my laptop.

Confirmed, on Ubuntu 9.04, activating a menu like "Applications" makes it so that you can't alter the volume.
