Well I've came up with a decent workaround (at least i think so), you can force the mouse and xserver back in sync by using a simple command from the xautomation package. simply forcing the mouse pos to the origin of the desktop forces them back in sync.

I've written up a short guide http:// www.gen- x-design. com/archives/ workaround- for-ubuntu- 810-mouse- bug/ that shows the steps and how to wire it into a single keypress under gnome. This means when the mouse locks the fix is simply hitting a single key combo.
This has moved the problem to a minor annoyance for me.
it should be easy enough, to adapt this to other setups.
