This has been upstream since 5.16 and on 5.15 since 5.15.14, and in our 5.15 kernels since GA. So either we regressed or the test is flaky or bogus. Or this is not running a kernel we think it is. Is there any information on the running kernel here?

this is a test report for 5.15.0-77.84 in sru-20230612 (I have bug description updated)

the LTP test suite we use before the update does not include this test, so we don't have test history to compare with.
Maybe the test case is not properly designed for s390x? We will need to run this on an s390x instance with older instance to find out if it's failing from the very beginning.

This issue can be found on Kinetic 5.19.0-47.49 with s390x instances as well.

i've seen the same failure on mediatek arm64 board if lxd snap is installed. if cgroup has been remounted without nsdelegate option, the test case will fail due to open cgroup.proc without permission.
