under downstream rally testing with queens this bug may not have been fully fix by this patch

i have traiged the downstream bug as vaild so it will enter our backlog and if we find a more resaonable reporduce then run rally and hope it breaks we will update the bug.

we likely wont start working on this imidely but hopefully this would be reproducible with a functional test.
