@LucaDC - not much I can do beyond trying to cross-link reports that will help to narrow down the issue and pinpoint any underlying (mis-)concepts in the selection algorithms. I revisited this report when sorting through a more recent 'super bug' about selection issues, which describes among others one problem with nearly the same wording: «only the topmost selected, even though cursor is above lower one» (issue 5).
While in my tests the behavior is zoom-dependent, I can confirm that within the 'grab sensitivity' distance (measured in screen pixel) the top-most object seems preferred or selected with higher priority than an object right below the mouse pointer.
Since I usually have 'grab sensitivity' set to 4 px, this behavior is less noticeable to me (as well as because my documents are usually small in scale (400 x 400 px) and I got used to zoom in for precise selection ;) )
