I see this as a 'paper cut' because its a usability issue that can easily be fixed. For example, If I were to right-click on a webpage inside Firefox, it does not cause any problems because the mouse pointer is not automatically selecting something from the menu. But if I was to right-click anywhere in nautilus or on my desktop, the 'create folder' or 'properties' is automatically selected. So it is very easy to click it by mistake, especially if you have a bit of a sticky mouse button.
I like the way its done in firefox; there is an initial gap between the mouse pointer and the right-click menu.
