trying to delete a paused instance returns permission error

Bug Description
start an instance, pause the instance
In the drop down box the terminate instance option is removed (as long as the instance is paused)
But still, it's possible to try to terminate the instance via checkbox on the left and then hit "Terminate instances" button.
The error displayed is:
× Error: You do not have permission to terminate instance:
Which is just misleading.

I'll give you that the error message is misleading. That would ideally be fixed.
However batch actions by their very nature have to be tolerant of failure for some subset of the inputs, so I don't think there's anything to be done about being able to select the paused instance and attempt to terminate it that way. We can't know the user's intent ahead of time.
