I've just installed ubuntu updates to kernel 3.8.0-21.37 and the brightness bug is back again.
I'm switching back to your pathced kernel 3.8.0-19-generic #30+lp1169376.
It seems that your patch has not been merged into official repos... :(

Have you any patched version of 3.8.0-21 ?
