Hm. This patch ( https://bugs.launchpad.net/debian/+source/toshset/+bug/644898/+attachment/1785664/+files/toshiba_acpi.patch _ seems to be stable with 2.6.38. BTW, you can compile just the needed module.

Here is the archive with the source, Makefile and precompiled module. You can copy it to your modules directory and update initramfs or just run "sudo make install" in the directory where you unpacked the archive.
