Apologies, I could have made it more clear which charm code I was referring to: The unit which has no agent is the hacluster charm, and since that charm has no agent up, that charm code is not in effect.

I do think there is a Juju bug here. Juju needs to be able to spawn subordinate units even when a principle charm application is very busy (for whatever reason).
