Why not? Can you give a use case for this or a compelling argument as to why the default behavior should be changed?

For example if there is something in the recycle bin, we should see "Empty
recycle bin", but if there is nothing this should be inactive. This seems
more convenient for me.

Can you be further specific? Do you mean when you right click upon the trash can on the desktop or do you mean when you open the file manager to the trash folder the little bar with the button labeled empty trash?

"Neither one, nor the other. I mean the trash-can add-on, which can be added
to the bottom panel by right clicking on it and selecting the "Add to
panel..." item for the pop-up menu. This latter one does not sense the fact
that the trash can has been emptied. Otherwise, the other two instances of
trash bin that you have mentioned do behave as expected."

Ah fantastic, I know what you mean now. I'm mark it as new, since I believe enough information has been provided, soon as I find out the correct package to attach it to I shall do so.
