This error message means that one of the partitions on the disk is in use, so the kernel is refusing to update its internal partition map because this would clobber the in-use filesystems. This is not a kernel bug, it looks like an installer bug.

Please reproduce this error, and attach the contents of /proc/mounts and /proc/swaps.
