Sorry for the lack of progress, I was off for a couple weeks during the holidays and am getting caught up.

Upstream 4.4 doesn't have the permission problem because we've backported some patches from newer kernels to provide some additional features. It's one of those patches that causes the problem.

It is an upstream problem though, so I'm trying to work out a solution with the upstream maintainers. I'll keep you posted.
