Global menu can be confusing if focused window is hidden

Bug Description
I know there are lots of bugs about the new global menu, but I'm not sure this has been reported. Basically, on occasion, you can find that the currently focused window (and therefore the global menu) is *underneath* another maximised window.
This seems to happen when starting new apps. I attached a screenshot that shows Firefox focused, and controlling the global menu, but the foreground maximized window is XChat! Very confusing.
