Bug Description
The Nautilus session managing the desktop in Unity is picked up as an open Nautilus window if the desktop has focus. This is not just an eyesore, but gives the user the chance to accidentally "open a tab" or something and cause the desktop to go blank with the "tab close" button being pushed just under the top bar.
This should be changed so that Unity's global menu blacklists the instance of Nautilus that is managing the desktop.

I can't reproduce what you're seeing (the nautilus menu does not show up upon mouseover), I can access it, though, by pressing left/right when an indicator is open. See a related bug #769254.
