Windows which are not maximized on program start should not show up "under" the Unity launcher

Bug Description
Binary package hint: unity
In Unity 3.4.6, when I launch the Console (which has by default a small, not maximized window), it shows up right under the Unity launcher.
With the "intellihide" or "dodge windows" options active, the launcher hides immediately.
I think this is papercut : why hiding the launcher because of a small window, if there is space enough on the desktop to show both the window AND the Unity launcher ?
I think this is just some Compiz placement rule to fix, but I don't know exactly how to do it.
This happens, obviously, with other utilities which are not started in fullscreen.
