Dash opens behind unity modal dialog

TEST CASE:
1. Launch gnome-terminal
2. Launch a command e.g python
3. Click on the window button to close the terminal and open a modal dialog
4. Press SUPER+F2 or click on the BFB to open the dash

Result:
The dash opens between gnome-terminal and the modal dialog and the dash has focus. (see screenshot)

I can't reproduce this bug with the given test case (same unity version).

Hm, I can reproduce systematically on a system with many application (for example open the about dialog then the dash) but not on another.

could a previous crash on that system have broke windows stacking ? I'm setting to incomplete and will try to find a more complete test case.

Can reproduce this with a variety of programs. I have to minimize windows in order to see the dash. That is, unless unity crashes when i press the the dash button. It crashes about 70% of the time.
