I've run into this same error multiple times while trying to install Ubuntu 9.04 Januty to a nvidia fakeraid setup. I've tried both with ext3 and xfs. It appears that the issue is with getting GRUB to install to the fakeraid. I've had this problem with just about every version of Ubuntu that I've tried to install to my fakeraid setup (I know, fakeraid is called that for a reason, but it works just fine in Windows - which I use on the same RAID for games).
