chroot ${rootmnt} /sbin/load_policy -i
But filesystem contain /usr/sbin/

I just hit this problem. It looks like policycoreutils in hardy shipped both /sbin/load_policy and /usr/sbin/ load_policy, but intrepid only ships the latter. As the reporter states, the initrd script assumes the presence of the former. Following an upgrade from hardy to intrepid, selinux breaks. I edited the script to refer to /usr/sbin/ load_policy, regenerated the initrd and rebooted, and selinux now initializes properly.
