Can't select 5Ghz in infrastructure mode

Bug Description

5Ghz is possible in ad-hoc mode, not in infrastructure mode (option to select band is not offered)

tested with kernel
3.13.0-34 - firmware 22.24.8.0
3.13.0-35 - firmware 22.24.8.0
3.17.0-999 (8 september 2014) - firmware 23.214.9.0

Very occacionally there is made a connection at 5 Ghz N (visible at network controller of access points)
