You may need to run the following:

sudo apt-get install -f
sudo apt-get clean
sudo apt-get update

Then re-install the package.

If that does not resolve your issue, please mark the bug as "Confirmed"

did not resolve the issue - however after some more googling and checking on the system I found that the package at fault was nvidia-common.

I went back to 2.6.32-38 using sudo apt-get remove linux-headers-2.6.32-41 , 40, and then 39 to get back to 38 where the problem started.

At this point the update errors stopped, and then I uninstalled nvidia-common , restarted, and then reinstalled nvidia-common.

The system could then update with errors, staying on 38.

This evening I have run update again where it asked to do a partial update which it completed successfully.

I am back to running 2.6.32.41.48 according to the Synaptic Package Manager, with no evident problems.

That should read:

The system could then update without errors, staying on 38.

I should also add that I had to go in to Synaptic Package Manager to select the 41 linux package and then mark it for installation to get to 41.48.

That version is no more supported; and no expecting backport as it only concern 'security' problem.
