Taken from networkmanager-list as adviced by Dan Williams.

What you really want to do is get your distro to apply the "scan
capabilities" patch to their kernel, and then backport the NM scan
capabilities patch to your distro's NM version.

And for the 0.6.x version of NM and the needed part, a seperate bug will be filled.

This is my patch of linux-source-2.6.22 based on Dan Willimas's patch I also correct the EXTRAVERSION number reported in this my bug report https://bugs.launchpad.net/bugs/186346

How can I test for this? It does not appear to be true in my case:

NetworkManager: <info> wlan0: Device is fully-supported using driver 'iwl3945'.
NetworkManager: <info> wlan0: driver does not support SSID scans (scan_capa 0x00).

Not sure what's up here. Did the patch get removed again?
