Wrongly claims to be using battery or that battery is at 1%

Bug Description

Laptop: Asus M2400N.
Situation with hoary: fully working battery state infomation without any problems.
Situation with breezy: the system is nearly always reporting, it uses the battery. Only after
plugging in the power supply it shows this correctly, but get's back to "using battery" as the
battery is fully charged. From time to time the gnome applet even reports, the battery has "1%
charge, enough for 600 minutes" and similar (slightly different numbers) more funny messages.

same. Rebootet with that in /boot/grub/menu.lst at the end of the kernel line and just after login I see the
green battery icon.

Did the batter status work with earlier versions of linux.
Does it work better with the latest upstream -mm kernel?
