05ac:1297 Ipheth driver not working

Binary package hint: linux-image-2.6.38-8-generic

Using iPhone 4 for internet tethering. With the driver shipped with kernel the dhclient (networkmanager) is not able to obtain an IP and tethering is not working. So I compiled git driver (git clone git://github.com/dgiagio/ipheth.git) and replaced kernel native driver with git version: now everything works. This seems to be a well known problem related to the kernel, not directly to Ubuntu: could you include that patch anyway, please?
