Wrong grub background after update-grub

Bug Description
The newly generated file /boot/grub/grub.cfg is missing lines 90,91,92 compared to the livecd or postinstallation file.
Fresh installation of Ubuntu 13.04 /boot/grub/grub.cfg contains these lines (87-93):
### BEGIN /etc/grub.
set menu_color_
set menu_color_
if background_color 44,0,30; then
clear
fi
### END /etc/grub.
When I use update-grub the whole if function is missing resulting in a monochromatic grub theme instead of the default background color:
