update-grub adds xen to menu with non xen kernel

Bug Description

Found Xen hypervisor 3.3, kernel: /boot/vmlinuz-2.6.38-8-generic
Found kernel: /boot/vmlinuz-2.6.38-8-generic
Found kernel: /boot/vmlinuz-2.6.35-28-generic
Found kernel: /boot/memtest86+.bin
Updating /boot/grub/menu.lst ... done

if I attempt to boot from the xen stanza it soon crashes!

$ grub --version
grub (GNU GRUB 0.97)

grub 0.97-29ubuntu61

 $ lsb_release -rd
Description: Ubuntu 11.04
Release: 11.04

I upgraded from 10.10 this week and in that version there was no Xen line in the grub menu.
