Unless you deliberately deletes the old menu.lst before you run update-grub, but that doesn't rhyme withe "update".

You reported this bug a while ago and there hasn't been any activity in it recently. We were wondering if this is still an issue for you. Can you try with the latest Ubuntu release? Thanks in advance. The bug is certainly still present because this code hasn't changed. I don't see that it's useful to set confirmed bugs back to 'incomplete' just because they're old - there's nothing incomplete in the report, and it shouldn't be discarded based on whether the submitter has time to reply to pings. I'm actually not sure if this should be considered a bug at all, but it at least is not "incomplete".
