laptop powers down after first battary is empty but 2nd is still full

Bug Description

ubuntu 11.10 64bit out of the box installation. using btrfs instead of ext4.

gnome-power-manager:
  Installed: 3.2.0-0ubuntu1
  Candidate: 3.2.0-0ubuntu1

my 2 battary laptop will be shutdown (or hibernated) after the first battary is empty. but the 2nd battary is still full and i have another 6 hours of runtime left.

the laptop:
panasonic toughbook cf-31 K
k stands for mk-3 where the cpu architecture changed

some guesses:
i used to use opensuse. it worked fine with kernel 2.6.37 and started to make problems with version 2.6.38. 2.6.39 got it even worse.
but 3.0 was fine.
